Indian Railway fined for not providing Seat

New Delhi, June 5: The Indian Railways has to pay Rs 75,000 to a man for the inconvenience suffered when his reserved seat was occupied by unauthorized people for the most part of his journey, The State Consumer Commission issued order here on Sunday.

Coming to Details, A passenger named V Vijay Kumar has reserved a seat on March 30, 2013, from Visakhapatnam to New Delhi, in Dakshin Express was occupied by someone else and suffered inconvenience.

Kumar, who claims to be suffering from knee joint pain, had booked a lower berth. At Bina station in Madhya Pradesh, several people allegedly boarded the compartment and occupied Kumar’s seat, he said.

He also complained that they had created a nuisance, causing inconvenience to other passengers too who were in that compartment. Kumar tried to complain about the situation to ticket checker or any railway official, but he could not find any authority at that time.

Later, he filed a complaint to The Delhi State Consumer Disputes Redressal Commission (SCDRC) and in response, SCDRC upheld the district forum’s order which had asked the railways to deduct one-third of the compensation of the ticket checker who has failed to operate his duty, It said.

The bench headed by its President Justice Veena Birbal said 'The compensation of Rs 75,000 awarded by the district forum is reasonable and appropriate.'

However, The Commission refused to enhance the compensation awarded to Delhi resident Kumar.
