Political parties should furnish no dues certificate: EC

New Delhi March 27: The Election Commission(EC) has written to political parties seeking their view on the issue and how to implement the Delhi High Court directive that not only candidates but also political parties should furnish no dues certificate before fielding their candidates.

"When we were examining the HC order, it was pointed out that it not only pertains to candidates but also to political parties. We have sought political parties’ views on how to go about with it," CEC Nasim Zaidi said.

In August 2015, the Court directed the EC to ensure that candidates contesting polls furnish a 'no dues certificate' from the agencies providing electricity, water and telephone connections to them. The order said the same rule should apply to political parties also.



The EC has already written to the Law Ministry urging it to amend election laws so that candidates who have defaulted in clearing dues can be barred from contesting polls.

According to the EC, barring candidates will require amendment to the chapter-III of the Representation of the People Act which deals with electoral offences. A new clause will have to be inserted therein for disqualification "on the ground of being a defaulter of dues". The issue is pending with Government.
