A Man sentenced to jail for 10 years for raping a minor girl

A special court in Mumbai has sentenced a man to 10 years in jail for raping his minor daughter.

The accused father, who lived with his second wife and five children, was found guilty of raping his 15-year-old daughter.

The victim alleged that she was sexually assaulted whenever her step-mother went to live with her parents along with her own children.

The 15-year-old girl, who has studied till Class 5, said that on January 21, 2016, she was raped by her father.

The victim soon informed a friend, who in turn informed a social activist who used to work with a Non-Government Organization (NGO).

The social activist then informed police about the assault, following which the victims father was arrested.

Police seized the clothes of the girl and her father and sent them for forensic examination.

The father alleged that the girl had an affair with a boy and since he had scolded her, she was levelling this false allegation.

The father also alleged that he had a dispute with the social worker and therefore, at her instance, a false report was lodged against him.

The court, however, looked through the case papers and observed that there were no injuries to the girls private parts and no semen was found on her clothes. But, semen marks were found on the fathers clothes.

The special judge Bharti Kale observed that just because the incident had been brought to light by a social worker does not mean that it was a false case, as alleged by the convict.

Merely working for an NGO will not establish that she [social worker] had instigated the victim to lodge a false report against the accused, said the judge.

The girl deposed before the court, which also relied on the testimony of her friend whom she had confided in.

There is no substantive evidence on record to show that the [social worker] had any reason to falsely implicate the accused. Therefore, it cannot be said that she instigated the victim to lodge a false report against him, the court said.
