H-1B visa: New rules allow outright rejection of applications

New delhi, July 19: In a further tightening of Visa Rules, the Trump Administration has empowered officials to reject Visa Applications under certain circumstances- if the required initial evidence wasn't submitted or it failed to establish eligibility for the visa sought.


H-1B visas got more difficult. United States Citizenship and Immigration Services (USCIS) has recently tightened the rules. H-1B visa has shown a strong attitude to accept applications. H-1B applications that are foreigners doing permits to work in the United States are very strictly enforced.


The New Rule which comes into effect from September 11, will impact companies sponsoring H-1B employees. The companies are less likely to get a second chance to submit more documentaory evidance or provide explanations that would substatntaite eligibility for the visa sought. In some instances, the outright denial of the application, say for the visa sought.


United States Citizenship and Immigration Services (USCIS) has issued this revised policy on July 13.


It has resclinded an earlier policy that restricted officilas ability to deny a case without first giving the applicant an opputunity to provide more evidance to prove the case.


H-1B visas are likely to face further hardship. If the application for H-1B visa extension is rejected, those individuals will have to leave the country. The applicants may seek the court if they feel that they have rejected their application without any errors. The impact of the new rules of the US is likely to seriously affect Indian IT employees and domestic IT companies.
