Punishing Convicts with death -Human way

Independent India many a time came across courageous judgments delivered by the Supreme court .whether it was finding fault in the election of prime minister around 1975 which later became a trigger point for the emergency declaration, or the recent various judgments
paving way for judicial activism.

At times the political leaders of our country rued it is as judicial activism and pointing that the judges were exceeding their limits.

The courts like other pillars of democracy are bringing human aspect in the way while delivering judgments.Now in our country, long-term convicts are provided educational facilities which render employment or earning potential, by the time they finish their jail term.

It is also not deniable to recognize the efforts of national,international and non governmental organisations (NGO) role, increased literacy aspect as the prime forces behind this trend.

In our country death by hanging is almost rid of as it is felt as inhuman practice, except in very rare cases.Now the Supreme Court's latest Judgment observed that a convict facing death penalty must have a painless, peaceful end of life.The hanging process should be replaced by a lethal injection process or by shooting - the SC opined.

The bench headed by Cheif Justice Dipak Mishra, Justices
AM Khanwilkar and DY chandrachud sent notices to government and parliament to explore less painful options to execute death sentence; as a response to a petition seeking section 354 (5) of criminal procedure code which prescribes death sentence by hanging the neck of convict until his death.An advocate's Public Interest Litigation (PIL) paved the way for this notice.
