Raheja Case: HC quashes case against IAS officers

Hyderabad June 21: The Hyderabad High Court has been quashed the action of the Special Judge ACB Court, Hyderabad in taking cognisance against the officers in the Raheja Mind Space case by here on Tuesday.

Justice B. Shiva Shankar Rao has been canceled this.

The Judge was allowing case filed by K. Ratnaprabha, L.V. Subramaniam, Partha Sarathy, B.P. Acharya, Gopi Krishan and P.S. Murthy. They held various positions in the Andhra Pradesh Industrial Infrastructure Corporation and Government at the relevant time.

Advocate T. Sriranga Rao filed a petition before the ACB Court complaining that the equity of APIIC in the Raheja Mind Space joint venture was reduced unilaterally and this caused extensive loss to the exchequer.



The Special Court took cognisance and issued the notice. These officers challenged the action of the Special Court in taking cognisance.

The Judge declared, ‘there is nothing to attribute any criminal common intention, breach of trust and cheating against the A1-4 & 7 and there is no criminal misconduct as public servants and there is no wilful acts on their part to cause any loss to Government or to benefit Raheja or its officials including A 5&6 and nothing shown of they involved by any agreement with A 5&6 to cheat the Government or to commit criminal breach of trust against Government and thereby none of the offences made out against them either under Sections 420 & 409 R/W 34 or even under Section 13(1)(d) r/w 13(2) of the PC Act.’

Justice Shiva Shankar Rao held that the Trial Judge has no power to review the previous dismissal or closure order in view of the specific bar under Cr.PC. It was declared that the cognisance orders passed by the Special Judge are unsustainable and are quashed.
