NEW DELHI MAY 15: The Special court has wondered, expressing serious concern. and questioned How are high potency anti-cancer drugs easily available in the market without any license or bill, putting people lives at risk.

Coming to details, The issue occurred when a pharma dealer, who did not have a permit and from whom such medications worth over Rs 50 lakh were allegedly recovered, and he approached the court seeking anticipatory bail.

It was the matter of serious concern that such medicines were freely available on the market, and also making the loss of income to the state exchequer, The court said.

Sanjeev Aggarwal, Special CBI Judged dismissed the anticipatory bail plea of Abhinav Pathak, director of Abhinav Biotech Pvt Ltd in Karol Bagh area of central Delhi from whom the drug inspector had allegedly seized drugs, which were put away without the imperative permit for distribution of allopathic drugs.

The court said that by all appearances an offense under the Drugs and Cosmetics Act was pulled in towards the accused, which involves a maximum imprisonment of five years and a fine of Rs one lakh or three times the estimation of the appropriated drugs, whichever is more.

The drug inspector had done the investigation at the pharma merchants office on May 4. He informed the court that the estimation of the seized medications was more than Rs 50 lakh and these costly medicines were utilized as a part of the treatment of cancer patients.

Pathak's counsel asserted that he had already applied for the license from the drug authorities and sought anticipatory bail and said he was ready to join the investigation.
